By now, all private sector firms in the UAE with 50 workers or more must have hired Emiratis in 2% of their professional positions. The Ministry of Human Resources and Emiratisation (MoHRE) declared recently that it had imposed penalties on firms that have not achieved their targets for 2022.

The Ministry levied “financial contributions” of Dh72,000 on businesses for each Emirati not appointed during 2022, it said in a report on Saturday. The MoHRE had before revealed to sources that non-compliant institutions would require to pay the fine in a single instalment.

A ministerial explanation given by the MoHRE* details the actions the administration would take if the establishment fails to pay the penalties:

– On the due date: The organisation shall be placed under e-follow-up to ensure its keeps with the payment of assessed donations.

– The day following the due date: MoHRE may stop the establishment’s distribution and renewal of work passes, and the employer will be informed regarding the basis for the same.

– The third, 10th, and 17th day after the due date: MoHRE shall send warnings and reminders to the non-compliant establishment, pressing it to recruit residents and pay the assessed subsidies.

– Two months after the due date: The MoHRE shall stop issuing and renewing work permits for all lone establishments or businesses owned solely by the owner of the violating establishment, considering the unity of partners.

– If the establishment fails to take the needed Emiratisation rates for two straight years: The establishment shall be reclassified and demoted to Category (3) according to the relevant criteria of classification backed by the Ministry.
