The 11th of December has been set aside for Bonginkosi Khanyile’s trial about his alleged role in the 2021 July riots. Khanyile made a quick Friday appearance in the Durban Regional Court.

In addition to violating the Disaster Management Act, he is accused of inciting violence.

Khanyile is accused of inciting violence after he urged to release former president Jacob Zuma from prison after he began serving a term for contempt of court.

Khanyile’s attorney was not in the courtroom. The state claims that he and his attorney agreed on the target date.

Khanyile claims he is not pleased with the trial date and had hoped for an earlier one.

“I was hoping for a quicker trial date, which is what I expected. Recall that this has been ongoing since 2021. The current year is 2023.

In 2024, the issue will maybe be resolved. Beginning in December 2023, the trial is new. At the police station, I swore that I hadn’t fled the country on Monday and Friday. 

Therefore, I wanted to let the court know that I am being punished even if I haven’t been penalised.

Yet, Khanyile’s choice to switch his legal team and pass his final exams delayed the trial even though the state had been signalling that it was prepared to begin since August 2022.

Natasha Ramkisson-Kara, a spokeswoman for the National Prosecuting Authority, said, “Remember, the matter had been put down in August last year for the trial to begin. 

The state has consistently been prepared to start. But, Khanyile’s legal counsel changed. Khanyile’s legal counsel was consulted when a trial date was sent, and he approved the dates. 

The date of December was decided upon after he stated that he would be accessible and that Khanyile would be writing exams in November.
