This arose after Aquillia D’Souza, manager of Virat Kohli and complainant, agreed not to proceed with accusations against the charged.

The Bombay High Court on Monday stopped and set aside the complaint against software engineer Ramnagesh Akubathini who was accused of allegedly tweeting threats on Twitter against the young baby of cricketer Virat Kohli and actress Anushka Sharma.

IIT graduate sends threats to the daughter of Virat Kohli: 

In November 2021, the Mumbai police arrested the IIT Hyderabad graduate from Telangana for allegedly sending offensive and intimidating messages targeting Kohli’s baby daughter following the Indian cricket squad’s defeat to Pakistan in the T20 World Cup game held on October 24, 2021.

A division court of Justices Ajey S Gadkari and Prakash D Naik gave the order in a criminal application by Akubathini, a state scholar, who filed a petition in February last year aiming to stop the FIR against him. The applicant argued that as he was a worthy pupil and a rank-holder in the JEE (Advanced) exam, continuing criminal proceedings would cause severe discrimination.

The appeal, discussed by advocates Abhijeet Desai and Karan Gajra for the suer, said Akubathini had been working with reputed companies and had no criminal prototypes against him, therefore the pending FIR would hinder his aim to pursue a master’s study outside India or any other opportunities.

Desai even argued that there was no proof to prove that the tweet in question had arrived from the IP address of the cell phone which belonged to the applicant, and just tracing such IP address cannot attribute the said offence to the applicant.

The petition said there is no concrete proof against the applicant for the commission of the said crime.

The justice court in Bandra had remanded the boy in police detention till November 16, after which he was sent to judicial control. After that, the magistrate gave bail to him on November 21, 2021, following that the tweets in question may not have been now addressed to Kohli or his family.
