Who Gets the Exemptions?

The USCIS clarified that the steep fee will not apply to existing visa holders, current F-1 student visa holders transitioning to H-1B status, L-1 intra-company transferees, or H-1B visa holders seeking renewals and extensions. Additionally, the proclamation does not affect previously issued visas or petitions submitted before 12:01 a.m. ET on September 21, 2025. This means that professionals already in the country can continue their work and studies without facing the new financial burden.

The exemptions provide substantial relief for approximately 300,000 Indian workers currently on H-1B visas in the United States, primarily employed in technology and services industries. Indian professionals form the backbone of the H-1B program, making this clarification particularly important for the Indian diaspora. The announcement also clarifies that H-1B holders can continue traveling in and out of the United States without restrictions, addressing major concerns raised following the fee announcement.
