On Wednesday, these Supreme Court will hear the petition of Republic TV editor-in-chief Arnab Goswami questioning Bombay’s high court order that refused to grant him temporary bail in the 2018 suicide case.

Cort refused Arnab’s Bail: 

The case is likely to be heard at 10:30 am by Justices DY Chandrachud and Indira Banerjee’s vacation bench. 

On Monday, the high court declined to grant Goswami and two others interim bail and ordered them to transfer to the local court.

Arnab’s appeal to Court: 

In his application to the supreme court filed by lawyer Nirnimesh Dubey, Goswami claimed that, according to news agency ANI, “the balance of convenience is also in favour of the petitioner and he will suffer irreparable injury and harm” if the high court order does not stay during the pendency of the present petition.

Goswami, currently incarcerated in Taloja prison in Navi Mumbai, called his arrest and “illegal” imprisonment a breach of his right to life and personal liberty conferred by article 21 of the 1950 Constitution of India.

Goswami has made the Centre, the Alibaug police station SHO, Mumbai Police Commissioner Param Bir Singh, and Akshyata Anvay Naik as parties to his appeal, apart from the Maharashtra government.

After the Bombay high court order, the 47-year-old journalist also filed a bail plea in the sitting court.

SCBA objected “extraordinary” listing:

Shortly after the case was listed for Wednesday morning, the president of the Supreme Court Bar Association (SCBA) objected to the “extraordinary” listing of the Goswami petition and asked the secretary-general of the high court to reveal whether the Chief Justice of India (CJI) had given any order or instruction to list the matter in this regard.

Suicide case of 2018: 

Goswami was arrested on November 4, along with two other defendants, Feroz Shaikh and Nitesh Sarda, in connection with the suicide abetment case of designer Anvay Naik as well as his mother Kumud in 2018.

 In a suicide note, the designer had alleged that the businesses of the accused had not paid their dues. The three suspects were later brought before a judge who, until November 18 refused to send them into police custody and kept them in judicial custody.

The Republic TV editor was initially held at a local school designated as the Alibaug prison’s Covid-19 quarantine centre. However, after reportedly being found using a cell phone while in judicial custody, he was sent to the Taloja jail in Raigad district on Sunday.

Pradeep Bhandari To CJI: 

“On Sunday, Pradeep Bhandari, a consulting editor for the Republic news channel, wrote to CJI SA Bobde asking him to take cognizance of Goswami ‘s transfer to Taloja Jail to hold him allegedly with” hardened “and” underworld “criminals as well as provide him with” some kind of protection. He said that Goswami said that “his life is at risk.”
