The Patna High Court relieved Congress leader Rahul Gandhi on Monday by delaying the lower court’s ruling in the ‘Modi surname’ defamation case till May 15.

Earlier, Patna’s lower court had directed the Congress politician to appear on April 12 to argue his case in connection with a suit filed against him by former Bihar deputy CM Sushil Kumar Modi in 2019 for Gandhi’s claimed derogatory statements on ‘Modi surname’.

On April 22, Rahul Gandhi petitioned the Patna High Court to vacate the lower court’s summons in the defamation lawsuit filed against him by Bhartiya Janata Party (BJP) leader Sushil Kumar Modi.

“We had filed a restraining order.” When a case is already being tried in Surat court, it cannot be tried again in a different court…This is a violation of the law.

“The next hearing is scheduled for May 15, and also all lower court proceedings have been stayed until then,” Rahul Gandhi’s counsel, Advocate Virendra Rathore, told ANI.

Meanwhile, Sushil Modi’s counsel, Advocate SD Sanjay, stated that the “court has questioned him to keep the argument on the matter” on the record.

A Surat court had already sentenced Gandhi for his remarks and disqualified him as a Lok Sabha MP. As per protocol, he left his official Tughlaq Lane house on Saturday. The home was originally assigned to him after being elected in the Lok Sabha from Amethi in 2004.

The Congress leader said he was paying the “price for speaking the truth” as he left his house and moved to his mother, Sonia Gandhi’s residence in Delhi.
